1. Introduction
Welcome to FOZY — Focus Better, Become Better.
These Terms of Service govern your access to and use of the FOZY website and its study productivity features, including study tracking, Study Rooms, analytics, personalization, and the Notes tool.
By accessing or using FOZY, you agree to these Terms where applicable law permits such agreement. If you do not agree, you should stop using the service.
Where separate consent or parental authorization is legally required, these Terms alone do not replace that requirement.
2. Eligibility and Accounts
You must meet the applicable age and legal requirements to use FOZY.
If you are a minor, your use of the service is subject to applicable laws and any required parental or guardian authorization.
You agree to:
- Provide accurate information when creating or updating your profile.
- Keep your account credentials and access secure.
- Use your own account and not impersonate another person.
- Notify FOZY if you become aware of unauthorized access to your account.
- Avoid using another person's account without permission.
FOZY may require additional steps where necessary to protect accounts or comply with applicable law.
3. Description of Services
FOZY may provide the following features, depending on availability:
3.1 Study Timer and Tracking
You may use the study timer to record study sessions and review your study hours.
Study records and analytics are productivity tools. They may not always reflect every aspect of your actual study activity, and you are responsible for reviewing your records where accuracy matters.
3.2 Study Rooms
Study Rooms allow users to participate in shared study environments and view certain information about other members.
Room owners and members must use these features respectfully and comply with these Terms.
Information visible within a room may be accessible to its other members.
3.3 Snapshot Feature
If enabled and permitted, the snapshot feature is designed to capture an image approximately every two minutes and make it available to other members of the same Study Room.
By enabling this optional feature, you acknowledge that your snapshots may be visible to other members of that room.
You are responsible for deciding whether to enable camera access and should avoid capturing sensitive or confidential information.
You must not use snapshots to harass, threaten, impersonate, or otherwise harm another person.
You must not download, redistribute, publish, or otherwise misuse another member's image without appropriate authorization.
3.4 Study Room Map
The optional map feature may allow room members to share and view location information.
You are responsible for deciding whether to enable location sharing. You should consider the privacy implications before making your location visible to others.
You must not use another member's location to stalk, threaten, harass, or harm that person.
Do not attempt to identify, track, or expose another user's whereabouts outside the intended functionality of the service.
3.5 Analytics and Habit Personalization
FOZY may provide study analytics and personalized study-related prompts based on information associated with your account.
These features are intended to help you organize your study activity. They do not guarantee academic improvement, exam results, or any particular outcome.
3.6 Notes Tool
The Notes tool is designed to process selected lecture-note PDFs locally on your device and help prepare printable pages.
You are responsible for ensuring that you have the right to process any document you use.
You must not use the tool to infringe copyright, violate confidentiality obligations, or distribute materials unlawfully.
4. Acceptable Use
You agree not to:
- Use FOZY for unlawful purposes.
- Harass, threaten, bully, or abuse other users.
- Impersonate another person or misrepresent your identity.
- Attempt to gain unauthorized access to accounts, rooms, databases, or other systems.
- Interfere with the security, availability, or normal operation of the service.
- Introduce malicious software or attempt to exploit vulnerabilities.
- Scrape, collect, or misuse other users' information without authorization.
- Use snapshots or location information to invade another person's privacy.
- Distribute unlawful, abusive, or harmful content through the service.
- Circumvent access controls or security restrictions.
- Use FOZY in a way that violates applicable law or the rights of others.
You must respect the privacy and reasonable expectations of other users.
5. User Content and Responsibility
You are responsible for the information you submit, the profile details you provide, and your conduct in Study Rooms.
You must ensure that you have the necessary rights and permissions for any content you upload, display, or share.
You should not share passwords, financial information, confidential documents, or other sensitive information in a Study Room.
FOZY does not endorse every statement, image, or other item shared by users.
6. Privacy and Permissions
Your use of personal information and optional features is described in the FOZY Privacy Policy.
Camera and location permissions are optional features that should be enabled only when you understand how they work.
You may disable these features through the relevant application settings or device permissions. Disabling a permission may make the associated feature unavailable.
These Terms do not replace any separate consent or notice required by applicable law.
7. Intellectual Property
FOZY and its original branding, logo, website design, software, and other original materials may be protected by applicable intellectual property laws.
Except where permitted by law or expressly authorized by the relevant rights holder, you may not copy, modify, distribute, sell, or commercially exploit protected FOZY materials.
Third-party names, trademarks, software, and content remain the property of their respective owners.
Nothing in these Terms transfers ownership of your personal content to FOZY merely because you use the service.
8. Service Availability and Changes
FOZY may be updated, modified, or maintained from time to time.
Features may occasionally be unavailable because of maintenance, technical issues, network problems, third-party service interruptions, or other circumstances.
We will take reasonable steps to maintain the service, but uninterrupted availability cannot be guaranteed.
Where appropriate, we may add, modify, suspend, or discontinue features, subject to applicable law and any obligations that apply to us.
9. Account Restrictions and Termination
FOZY may take reasonable action to protect the service and its users if an account violates these Terms, compromises security, or engages in unlawful or harmful conduct.
Depending on the circumstances and applicable law, action may include a warning, restriction of a feature, suspension, or account termination.
Where appropriate, users may be given an opportunity to address a violation or appeal a decision.
You may stop using FOZY at any time. To request account or data deletion, contact FOZY at supportfozy@gmail.com.
Account termination does not automatically mean that every copy of all related information is immediately erased from every system or backup. Any applicable retention and deletion process is described in the Privacy Policy and remains subject to applicable law.
10. Educational and Productivity Disclaimer
FOZY is a study productivity tool. It is not a substitute for professional educational guidance or individual academic judgment.
Study timers, analytics, and personalization features are provided to help you organize your learning.
FOZY does not guarantee specific examination results, grades, ranks, admissions, or other academic outcomes.
You remain responsible for your study decisions and the way you use the information provided by the platform.
11. Limitation of Liability
To the extent permitted by applicable law, FOZY is not responsible for losses arising from circumstances outside its reasonable control, including third-party service interruptions, connectivity failures, or misuse of information shared by users.
Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
These Terms do not remove rights or remedies available to you under applicable law.
12. Third-Party Services
FOZY may depend on third-party services to provide authentication, hosting, mapping, or other functionality.
Your use of those services may also be subject to the relevant provider's terms and policies.
FOZY does not control every aspect of third-party services and cannot guarantee their uninterrupted availability.
13. Changes to These Terms
We may update these Terms to reflect changes in the service, features, or applicable legal requirements.
Where appropriate, material changes will be communicated through the website or another reasonable method.
The updated Effective Date will appear at the top of this page.
Continued use of FOZY after a change takes effect will be subject to the updated Terms to the extent permitted by applicable law. Where fresh consent is legally required, we will seek it separately.
14. Governing Law
These Terms are subject to the laws applicable in India, without removing any mandatory rights or protections that apply to users under applicable law.
Any dispute will be handled by the competent courts or other forums as determined under applicable law.
